Swipy Terms of Use

These Terms of Use govern your access to and use of the Swipy website, mobile applications, APIs, and related services (collectively, the “Service”).
Swipy is operated by Bern Software (“Swipy,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use Swipy.
1. Eligibility
You must be at least 13 years old and old enough to consent to digital services under the laws of your country.
If local law requires consent from a parent or legal guardian, you may use Swipy only after obtaining that consent.
You may not use Swipy if you are legally prohibited from receiving or using the Service.
2. Accounts
You agree to:
- Provide accurate and current account information.
- Keep your password and login credentials confidential.
- Notify us if you suspect unauthorized access.
- Accept responsibility for activity performed through your account.
- Not impersonate another person, business, artist, or organization.
- Not create misleading, fraudulent, or automated accounts.
We may require email verification or other reasonable verification measures to protect the Service.
3. Description of the Service
Swipy is a music-focused social platform that allows users to:
- Share Spotify music links.
- Publish captions and comments.
- Follow users and hashtags.
- Like and repost content.
- Join music-related social features.
- Receive personalized music and community recommendations.
- Purchase or access optional premium features.
Features may be added, changed, suspended, or removed as the Service develops.
4. Spotify Content
Swipy is not affiliated with, endorsed by, or sponsored by Spotify.
Spotify names, trademarks, artwork, links, embeds, and playback experiences belong to Spotify or the applicable rights holders and remain subject to Spotify’s terms and policies.
Swipy validates public Spotify links and uses Spotify’s public oEmbed functionality to display music information. Swipy does not require or store your Spotify password or Spotify access token for this process.
Spotify content may become unavailable, restricted, or changed without notice.
5. User Content
“User Content” includes posts, captions, comments, profile information, images, links, reports, and other material you submit to Swipy.
You retain ownership of your original User Content.
By submitting User Content, you grant Swipy a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, distribute, and make that content available as necessary to:
- Operate the Service.
- Display your content to other users.
- Provide social and recommendation features.
- Secure and improve the Service.
- Promote Swipy and its community.
This license ends when your content is deleted, except where copies must remain temporarily in backups, have been shared by others in a permitted manner, or must be retained for legal, security, or safety reasons.
You confirm that you have all rights and permissions required to submit your User Content.
6. Community Rules
You may not use Swipy to:
- Post illegal, infringing, fraudulent, deceptive, hateful, or abusive content.
- Harass, threaten, stalk, impersonate, or expose private information about another person.
- Exploit or endanger a minor.
- Violate copyright, trademark, privacy, publicity, or other rights.
- Share music, images, or other material without permission.
- Send spam or manipulate likes, follows, comments, or other engagement.
- Operate unauthorized bots, scrapers, or automated accounts.
- Upload malware or attempt to bypass security controls.
- Probe, attack, overload, or disrupt the Service.
- Circumvent suspensions, blocks, moderation decisions, or access restrictions.
- Use Swipy for fraud, unlawful sales, or other illegal activity.
7. Moderation
We may investigate reports and take reasonable action to protect users and the Service.
Actions may include:
- Reducing the visibility of content.
- Hiding or removing content.
- Restricting account features.
- Suspending or terminating accounts.
- Preserving relevant records.
- Reporting serious conduct to appropriate authorities where legally required.
We are not required to monitor every post and cannot guarantee that all content will be accurate or appropriate.
Users may use Swipy’s reporting and blocking features to manage unwanted interactions.
8. Premium Features and Subscriptions
Some Swipy features may be offered through paid or automatically renewing subscriptions.
Mobile purchases may be processed through Apple App Store, Google Play, RevenueCat, or another authorized payment platform.
The price, billing period, trial terms, and included benefits will be shown before purchase.
Unless cancelled before the renewal date, a subscription may renew automatically. You must manage or cancel subscriptions through the store account used to make the purchase.
Deleting the Swipy application or your Swipy account does not automatically cancel an Apple or Google subscription.
Refund eligibility is determined by the applicable store, payment provider, and mandatory consumer-protection laws.
9. Swipy Intellectual Property
The Service, including its software, interface, visual design, trademarks, logos, and non-user content, is owned by or licensed to Swipy and Bern Software.
These Terms grant you a limited, personal, non-exclusive, revocable, and non-transferable right to use the Service.
You may not copy, sell, license, reverse engineer, distribute, or commercially exploit Swipy’s software or intellectual property except where expressly permitted by law.
10. Third-Party Services
Swipy may rely on or link to third-party services, including Spotify, Apple, Google, Firebase, RevenueCat, hosting providers, and notification services.
We do not control their independent services, content, availability, or policies.
Your use of a third-party service may be governed by that provider’s terms and privacy policy.
11. Availability and Updates
We work to keep Swipy secure and available, but we do not guarantee uninterrupted or error-free operation.
We may:
- Perform maintenance.
- Release updates.
- Change technical requirements.
- Limit certain features.
- Discontinue part or all of the Service.
You may need to install updates to continue using Swipy.
12. Disclaimers
To the extent permitted by law, the Service is provided on an “as is” and “as available” basis.
We do not guarantee:
- Continuous availability.
- Error-free recommendations.
- The continued availability of any Spotify content.
- That User Content is accurate, complete, or appropriate.
- That use of the Service will meet every personal requirement.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
13. Limitation of Liability
To the maximum extent permitted by law, Swipy and Bern Software will not be liable for indirect, incidental, special, consequential, or punitive losses, including loss of data, profits, goodwill, or opportunities.
Our total liability for claims relating to the Service will not exceed the greater of:
- The amount you paid to Swipy during the 12 months before the claim; or
- The minimum amount of liability required by applicable law.
These limitations do not apply where liability cannot legally be limited.
14. Account Deletion and Termination
You may stop using Swipy at any time.
You may request account deletion through available account settings or the Contact Us page.
We may suspend or terminate an account when reasonably necessary because of:
- Serious or repeated violations of these Terms.
- Fraud or security risks.
- Harm to users or the Service.
- A valid legal requirement.
- Discontinuation of the Service.
Provisions that should reasonably survive termination, including ownership, disclaimers, and liability limitations, will remain effective.
15. Changes to These Terms
We may update these Terms when our Service, practices, or legal obligations change.
We will update the effective date and provide additional notice where required.
Continuing to use Swipy after revised Terms become effective means you accept those Terms where permitted by law.
16. Applicable Law
These Terms are governed by the laws applicable to the operator of Swipy.
Nothing in these Terms removes mandatory consumer rights or legal protections available in your country.
